Terms and Conditions of Use

1. Subject
Abbe Photo, the brand of the association Istoria Fotografia (hereinafter referred to as «Abbe Photo») developed a content publishing platform accessible on a website at https://abbe.photo and shortly in the form of a mobile app, hereinafter referred to as «Site». The purpose of these conditions is to govern access to the Site and its conditions of use. Be sure to read them carefully. You understand and acknowledge that Abbe Photo is not part of any contractual agreement, contract or relationship, of any kind, between the members of the Site. Clicking on « Create » By entering your email address or by clicking on one of the proposed social networks (such as Facebook and Google), you acknowledge that you have read and accepted all these terms and conditions of use.
2. Definitions
In this document, « Article » means an article consisting of text, photo and any audiovisual content; «Terms and Conditions of Use» means these general conditions; «Account» means the account that must be created to become a member and access certain services offered by the Site; «Facebook account» has the meaning given to it in Article 3.2 below; «Content Member» has the meaning given to it in Article 11.2 below; «Member» means any person who has created an account on the platform; «Member Passadoc» means any member who is a member to support «The Passadoc Association» ; one «Site» has the meaning given to it in Article 1 above; «Services» means all services provided by Abbe Photo via the Site; «Website» means the website available at https://abbe.photo.
3. Registration on the platform and creating an account
3.1. Conditions for registration on the platform
The platform can be used by people aged 18 and over. Registration on the platform by a minor is prohibited. By accessing, using, or registering on the Site, you declare and guarantee that you are over 18.
3.2. Creating an account
The Site allows Members to fill in their profile, display useful information about the system, and be able to be matched with another user (member) by a member. You cannot see the information if you are not registered on the Site. However, you cannot contact another user without having previously created an Account and become a member.
To register on the Site, you must have read and accept these Terms of Use and Privacy Policy. When creating your account, you undertake to provide accurate information, and update it via your profile or by warning Abbe Photo, to ensure its relevance and accuracy throughout your contractual relationship with Abbe Photo. In the case of an e-mail registration, you agree to keep the password chosen when creating the account secret and not to communicate it to anyone. In case of loss or disclosure of your password, you undertake to inform Abbe Photo immediately. You are solely responsible for the use of your account by third parties, unless you have expressly informed Abbe Photo of the loss, fraudulent use or disclosure of your password by a third party. You undertake not to create or use, under your own identity or that of a third party, accounts other than those originally created.
3.3. Verification
Abbe Photo can, in the interests of transparency, confidence-building, fraud prevention or detection, set up a system to verify some of the information provided on your profile. This is particularly the case when you enter your phone number or provide an identity document. You acknowledge and accept the fact that any mention on the Site or Services for « check » information, or other similar term, only means that a member has passed the existing verification procedure on the Site or Services in order to provide you with more information about the Member with which you plan to use the system. Abbe Photo cannot guarantee the veracity, reliability or validity of the information covered by the verification procedure.
4. Use of Services
4.1. Interactions with another user
As a Member, and provided you meet the conditions below, you can complete your profile to maximize your chances of being read. You will then receive contact with other members and you can interact with him/her.
4.2. Enjoying services and events
As a Member, you can enjoy the services and events offered by Abbe Photo and/or Passadoc and/or other Members on the Site. These services allow you to enjoy discounts and/or good plans as a user of Abbe Photo and linked to your interests. Events allow you to get in touch with other Abbe Photo users in your area.
4.3. Rating system
4.3.1. Operation
Abbe Photo t Your opinion and the opinions left on you by other Members, if any, are visible to the public. You can ask the Site team to delete them (contacts below).
4.3.2. Moderation
You acknowledge and accept that Abbe Photo reserves the right to delete any article, comment, question, opinion or answer if he considers that its content violates its general conditions.
4.3.3. Limit
Abbe Photo reserves the right to suspend your account, limit your access to the Services or terminate these conditions in the event that you no longer use the system for at least six months or if you do not comply with the terms and conditions.
5. Financial conditions
Access, registration on the Site as well as completing your profile and interacting with other users is free. However, some content offered by Passadoc is reserved for its current members.
6. Non-commercial and non-profit purpose of the Services and the Site
You agree to use the Services and the Site only to exchange articles and be put in contact, on a non-commercial basis, with people who share interests with you. Abbe Photo reserves the right to suspend your account if you offer this action against payment / compensation. Abbe Photo also reserves the right to suspend your account, limit your access to the services or terminate these conditions in the case of an activity on the platform on your part which, because of the nature of the services offered, results in a profit situation for you, or for any reason suggesting to Abbe Photo that you generate a profit on the Site.
Abbe Photo and Passadoc being non-profit associations whose content is produced and made available by volunteers, neither Abbe Photo nor Passadoc can be held responsible for the unavailability and any malfunction of the Site and its content and services.
7. Commitment of all users of the Site
You acknowledge that you are solely responsible for respecting all laws, regulations and obligations applicable to your use of the Site. Moreover, as a Member, you agree to maintain a positive, respectful and caring attitude towards other users with whom you may be in contact.
In addition, when using the Site and during all your voluntary activities with Abbe Photo, you undertake to:
not to use the Site for professional, commercial or for-profit purposes
do not send false, misleading, malicious or fraudulent information to Abbe Photo (especially when creating or updating your account) or to other members
not to speak or publish any content on the Site of a defamatory, abusive, obscene, pornographic, vulgar, offensive, aggressive, inappropriate, violent, threatening, defamatory, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred, encouraging activities or the use of illegal substances, or more generally contrary to the objectives of the Site, likely to violate the rights of Abbe Photo or a third party or contrary to morals
the rights and image of Abbe Photo and Passadoc, including intellectual property rights
not to open more than one account on the Site or not to open an account on behalf of a third party
not to contact a member, including via the Site, for a purpose other than defined by the terms of Abbe Photo
to comply with these Terms and Conditions and the Privacy Policy
providing information about you
to contact another Member and / or administrator of the Site when you want to alert any abnormal behavior on the Site.
8. Suspension of accounts, access limits and termination
You can terminate your contractual relationship with Abbe Photo at any time, free of charge and for no reason. To do this, you can simply request the contact form on the Our Association page (or equivalent). In case of (i) breach of these conditions of use, including your obligations as a Member referred to in Articles 6 and 7 above, (ii) beyond the limit set out in Article 4.3.3 above, or (iii) if Abbe Photo has good reason to believe that this is necessary to protect its security and integrity, that of Members or third parties, or to prevent fraud or investigation, Abbe Photo reserves the right to:
terminate the General Conditions of Use binding with Abbe Photo immediately and without prior notice
prevent the publication or deletion of reviews, messages or content posted on the Site or on the pages of social networks administered by Abbe Photo and Passadoc
limit your access and use of the Site
temporarily or permanently suspend your account.
When necessary, you will be notified of the implementation of such a measure to allow you to provide explanations to Abbe Photo. Abbe Photo will decide on the measures put in place.
9. Personal data
As part of your use of the Site, Abbe Photo collects and processes some of your personal data. By using the Site and registering as a Member, you acknowledge and accept the processing of your personal data by Abbe Photo in accordance with the applicable law on the Privacy Policy.
10. Intellectual Property
10.1. Content published by Abbe Photo
Abbe Photo is the exclusive holder of all intellectual property rights relating to the Service, the Site, its content (texts, images, designs, logos, videos, sounds, data, graphics, etc.) and to software and databases that ensure their operation. Abbe Photo grants a non-exclusive, personal and non-transferable right to use the Site and Services, for your personal and private use, on a non-commercial basis and in accordance with the objectives of the Site and Services. Any use or operation of the Site and Services, as well as the content, is prohibited without the prior written permission of Abbe Photo.
In particular, it is prohibited to:
reproduce, modify, adapt, distribute, represent and publicly disseminate the Site, Services and Content, except those expressly authorized by Abbe Photo
"reverse engineering" the platform or services, subject to the exceptions provided for in the existing texts
extract or attempt to extract (including using data extraction robots or any other similar data collection tool) part of the data from the Site.
10.2. Content published by the user on the Site
In order to ensure the smooth functioning of the Services and in accordance with the objective of the Website, you guarantee Abbe Photo a non-exclusive contract allowing you to use the content and data you provide in connection with your use of the Services (hereinafter referred to as «Content»).
In order to allow Abbe Photo to distribute via the digital network and in accordance with any communication protocol (including the Internet and mobile network), and to provide the content of the Site to the public, you authorize Abbe Photo, all over the world, and throughout the period of your contractual relations, to reproduce, represent, adapt and translate your Content as follows:
you authorize Abbe Photo to reproduce all or part of your Content on any known or unknown digital recording media, including any server, hard disk, memory card or other equivalent media, in any format and by any known or unknown process, to the extent necessary for any storage, backup, transmission or download related to the operation of the Site
you authorize Abbe Photo to adapt, translate your Content, and reproduce these adaptations on any digital medium, present or future, stipulated in (i) above, with the aim of providing the services, especially in different languages. This right includes, in particular, the possibility of making changes to the formatting of your Content, in accordance with your moral right, in order to comply with the graphic charter of the Site and/or to make it technically compatible for publication via the Site.
11. Role of Abbe Photo
The Site is an online network on which Members can create an Account and be in contact with other users. By using the Site and accepting these Terms of Use, you acknowledge that Abbe Photo does not participate in any agreement between you and the other Member. Abbe Photo has no control over the behaviour of its members and users of the platform. It does not own, exploit, provide and manage exchanges between members.
12. Operation, availability and functionality of the Site
Abbe Photo will endeavour as much as possible to keep the Site accessible 7 days a week and 24 hours a day. However, access may be temporarily suspended without notice for reasons of technical maintenance, migration or updating, or due to breakdowns or constraints related to the operation of the network. In addition, Abbe Photo reserves the right to modify or suspend all or part of access to the Site or its features temporarily or permanently.
13. Modification of the general conditions of use
These General Terms of Use express the entire agreement between you and Abbe Photo regarding your use of the Services. Any other document, including any mention on the Site (articles, pages, questions/answers, etc.), is for indicative purposes only. Abbe Photo can modify these general conditions to adapt to its technological and commercial environment, and to comply with existing legislation. Any changes to these terms and conditions will be published on the Site with the effective date. Abbe Photo will notify you before it comes into force.
14. Applicable law – Disputes
These conditions are subject to French law. The competent court is the Commercial Court of Montpellier.
