Terms and conditions of use

1. Subject

Abbe Photo, the brand of the association Istoria Fotografia (hereinafter referred to as "Abbe Photo") has developed a content publication platform accessible on a website at https://abbe.photo and shortly in the form of a mobile application, hereinafter referred to as the "Site". The purpose of these terms and conditions is to govern access to the Site and its conditions of use. Please read them carefully. You understand and acknowledge that Abbe Photo is not a party to any agreement, contract or contractual relationship of any kind between members of the Site. By clicking on "Create" and entering your e-mail address or by clicking on one of the social networks offered (in particular Facebook and Google), you acknowledge that you have read and accepted all these terms and conditions of use.

2. Definitions

In this document, "Article" means an article consisting of text, photo and any audiovisual content; "Terms and Conditions of Use" means these general conditions; "Account" means the account that must be created to become a member and access certain services offered by the Site; "Facebook Account" has the meaning given to it in article 3.2 below; "Member Content" has the meaning given to it in article 11.2 below; "Member" refers to any person who has created an account on the platform; "Passadoc Member" refers to any member who is a member in support of "L'association Passadoc"; a "Site" has the meaning given to it in article 1 above; "Services" refers to all services provided by Abbe Photo via the Site; "Website" refers to the website accessible at https://abbe.photo.

3. Register on the platform and create an account

3.1 Platform registration conditions

The platform may be used by persons aged 18 and over. Any registration on the platform by a minor is prohibited. By accessing, using or registering on the Site, you represent and warrant that you are over 18 years of age.

3.2 Creating an account

The Site allows Members to fill in their profile, to display useful information about the system and to be matched with another user (Member) by a Member. You cannot see the information if you are not registered on the Site. However, you cannot contact another user without first creating an Account and becoming a member.

To register on the Site, you must have read and accepted the present terms of use and privacy policy. When creating your account, you agree to provide accurate information, and to update it via your profile or by notifying Abbe Photo, in order to ensure its relevance and accuracy throughout your contractual relationship with Abbe Photo. In the case of registration by e-mail, you agree to keep secret the password chosen when creating the account and not to communicate it to anyone. In the event of loss or disclosure of your password, you agree to notify Abbe Photo immediately. You are solely responsible for any use of your account by third parties, unless you have expressly informed Abbe Photo of the loss, misuse or disclosure of your password by a third party. You agree not to create or use, under your own identity or that of a third party, accounts other than the one initially created.

3.3. Verification

Abbe Photo may, in the interest of transparency, improving trust, preventing or detecting fraud, implement a system for verifying certain information provided on your profile. This is particularly the case when you enter your telephone number or provide an identity document. You acknowledge and agree that any reference on the Site or Services to "verifying" information, or any similar term, means only that a member has passed the verification procedure available on the Site or Services to provide you with more information about the Member with whom you are considering using the system. Abbe Photo cannot guarantee the truthfulness, reliability or validity of the information subject to the verification procedure.

4. Use of the Services

4.1 Interaction with another user

As a Member, and provided you meet the conditions below, you can complete your profile to maximize your chances of being read. You will then receive contact with other members and be able to interact with them.

4.2. Take advantage of services and events

As a Member, you can take advantage of services and events offered by Abbe Photo and/or Passadoc and/or other Members on the Site. These services allow you, as an Abbe Photo user, to take advantage of discounts and/or special offers related to your interests. Events allow you to get in touch with other Abbe Photo users in your area.

4.3. Scoring system

4.3.1. Operation

Abbe Photo encourages you to leave a review on the user with whom you have exchanged on the Site or with whom you were supposed to exchange. Your review, as well as reviews left on you by other Members, if any, are visible to the public. You may request that they be deleted by the Site team (contact details below).

4.3.2. Moderation

You acknowledge and agree that Abbe Photo reserves the right to remove any post, comment, question, opinion or response if it believes that the content violates these terms and conditions.

4.3.3. Limit

Abbe Photo reserves the right to suspend your account, limit your access to the Services or terminate these Terms if you have not used the system for at least six months or if you fail to comply with these Terms.

5. Financial terms and conditions

Accessing and registering on the Site, as well as completing your profile and interacting with other users, is free of charge. However, certain content offered by Passadoc is reserved for paid-up members. 

6. Non-commercial and non-profit purpose of the Services and the Site

You agree to use the Services and the Site only to exchange articles and to be put in contact, on a non-commercial basis, with people who share your interests. Abbe Photo reserves the right to suspend your account if you offer this in exchange for payment/compensation. Abbe Photo also reserves the right to suspend your account, limit your access to the services or terminate these terms in the event of any activity on your part on the platform which, due to the nature of the services offered, results in a profit situation for you, or for any reason suggesting to Abbe Photo that you are generating a profit on the Site.

As Abbe Photo and Passadoc are non-profit associations whose content is produced and made available by volunteers, neither Abbe Photo nor Passadoc can be held responsible for the unavailability or any malfunction of the Site and its content and services.

7. Commitment of all Site users

You acknowledge that you are solely responsible for complying with all laws, regulations and obligations applicable to your use of the Site. Furthermore, as a Member, you agree to maintain a positive, respectful and caring attitude towards other users with whom you may come into contact.

In addition, when using the Site and in all your volunteer dealings with Abbe Photo, you agree to:

• not to use the Site for professional, commercial or profit-making purposes

• not to send Abbe Photo (especially when creating or updating your account) or other members any false, misleading, malicious or fraudulent information

• not to speak, behave or publish any content on the Site of a defamatory, abusive, obscene, pornographic, vulgar, offensive, aggressive, inappropriate, violent, threatening, libellous, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred, encouraging illegal activities or the use of illegal substances, or more generally contrary to the objectives of the Site, likely to infringe the rights of Abbe Photo or a third party or contrary to good morals

• not to infringe the rights and image of Abbe Photo and Passadoc, in particular their intellectual property rights

• not to open more than one account on the Site or open an account in the name of a third party

• not to contact a member, in particular via the Site, for a purpose other than that defined by the terms of Abbe Photo

• to abide by these terms and conditions and the privacy policy

• enter your personal information

• contact another Member and/or the Site administrator when you wish to report any abnormal behaviour on the Site.

8. Account suspension, access limits and termination

You may terminate your contractual relationship with Abbe Photo at any time, free of charge and for any reason. To do so, simply use the contact form on the Our Association page (or equivalent). In the event of (i) violation of these Terms of Use, including your obligations as a Member mentioned in Articles 6 and 7 above, (ii) beyond the limit defined in Article 4.3.3 above, or (iii) if Abbe Photo has good reason to believe that it is necessary to protect its safety and integrity, that of Members or third parties, or to prevent fraud or investigations, Abbe Photo reserves the right to:

• terminate the Terms and Conditions of Use between you and Abbe Photo immediately and without notice

• prevent the publication or deletion of reviews, messages or content posted on the Site or on the social networking pages administered by Abbe Photo and Passadoc

• limit your access to and use of the Site

• temporarily or permanently suspend your account.

When necessary, you will be notified of the implementation of such a measure to allow you to provide explanations to Abbe Photo. Abbe Photo will decide what measures to take.

9. Personal data

As part of your use of the Site, Abbe Photo collects and processes some of your personal data. By using the Site and registering as a Member, you acknowledge and agree to the processing of your personal data by Abbe Photo in accordance with the applicable law on Privacy Policy.

10. Intellectual Property

10.1. Content published by Abbe Photo

Abbe Photo is the exclusive owner of all intellectual property rights relating to the Service, the Site, its content (text, images, designs, logos, videos, sounds, data, graphics, etc.) and the software and databases that operate them. Abbe Photo grants you a non-exclusive, personal and non-transferable right to use the Site and the Services, for your personal and private use, on a non-commercial basis and in accordance with the purposes of the Site and the Services. Any use or exploitation of the Site and Services, including the Content, is prohibited without the prior written consent of Abbe Photo.

In particular, it is forbidden to:

• reproduce, modify, adapt, distribute, publicly perform and publicly display the Site, the Services and the Content, except as expressly authorized by Abbe Photo

• "reverse engineering" of the platform or services, subject to the exceptions provided for in current legislation

• extract or attempt to extract (in particular by means of data extraction robots or any other similar data collection tool) any part of the Site's data.

10.2. Content published by the user on the Site

In order to allow the proper functioning of the Services and in accordance with the purpose of the Site, you grant Abbe Photo a non-exclusive license to use the content and data you provide in connection with your use of the Services (hereinafter referred to as "Content").

In order to allow Abbe Photo to distribute via the digital network and in accordance with any communication protocol (in particular Internet and the mobile network), and to provide the content of the Site to the public, you authorize Abbe Photo, everywhere in the world, and during all the period of your contractual relations, to reproduce, represent, adapt and translate your Content in the following way:

• you authorize Abbe Photo to reproduce all or part of your Content on any digital recording medium known or yet unknown, and in particular on any server, hard disk, memory card or any other equivalent medium, in any format and by any process known or unknown, to the extent necessary for any storage, backup, transmission or downloading operation related to the operation of the Site

• you authorize Abbe Photo to adapt and translate your Content, and to reproduce these adaptations on any digital medium, present or future, as stipulated in point (i) above, for the purpose of providing the services, in particular in different languages. This right includes, in particular, the possibility of modifying the formatting of your Content, while respecting your moral rights, in order to comply with the Site's graphic charter and/or to make it technically compatible for publication via the Site.

11. Role of Abbe Photo

The Site constitutes an online network on which Members can create an Account and be put in contact with other users. By using the Site and accepting these Terms of Use, you acknowledge that Abbe Photo is not a party to any agreement between you and any other Member. Abbe Photo has no control over the behavior of its members and users of the platform. It does not own, operate, provide or manage the exchanges between members.

12. Operation, availability and functionality of the Site

Abbe Photo will do its utmost to keep the Site accessible 7 days a week, 24 hours a day. Nevertheless, access may be temporarily suspended, without notice, for reasons of technical maintenance, migration or updating, or due to breakdowns or constraints linked to the operation of the network. In addition, Abbe Photo reserves the right to modify or suspend all or part of access to the Site or its functionalities temporarily or permanently.

13. Modification of the general conditions of use

These Terms of Use express the entire agreement between you and Abbe Photo with respect to your use of the Services. Any other document, in particular any mention on the Site (articles, pages, questions/answers, etc.), is for information purposes only. Abbe Photo may modify these terms and conditions in order to adapt to its technological and commercial environment, and to comply with current legislation. Any changes to these terms and conditions will be posted on the Site with the effective date. Abbe Photo will notify you before it takes effect.

14. Applicable law - Disputes

These conditions are governed by French law. The competent court is the Tribunal de Commerce de Montpellier.
